Fitzpatrick Obtains Infringement Judgment In Favor Of Client Metra Electronics Corporation
On January 20, 2011, Fitzpatrick moved the court for a default judgment against Best and Kewen Li. Judge Gutierrez granted the motion, finding in part that Best and Kewen Li had willfully violated a prior consent judgment entered against them in a previous suit brought by Fitzpatrick on behalf of Metra. As a result, Metra having in addition proved its lost profit and other damages, Judge Gutierrez awarded Metra the full amount of its requested damages for both patent and trademark infringement, including trebled damages for willful patent infringement, and also awarded Metra the full amount of its requested attorney fees.
