Don knows Patent Office practices and procedures, inside and out. His career started at the USPTO, where he was promoted to a primary examiner. Since joining Fitzpatrick, Don has drafted and prosecuted numerous patent applications. He has also represented clients in complex USPTO proceedings, including post-grant AIA trials, reissue applications, interferences, and reexaminations. Outside his Patent Office practice, Don provides counseling on patent and trademark related issues, such as due diligence investigations and opinions.
Don has expertise in diverse technologies in the chemical, pharmaceutical, and mechanical arts, such as small molecule drugs, medical devices, vehicle emission technologies, plastics, papermaking, and laser toner cartridge technology.
Don prosecuted key patent applications for Canon covering its laser toner cartridge technology. After guiding the applications through to issuance as patents, Don helped Fitzpatrick’s team obtain a General Exclusion Order and Cease and Desist Orders in International Trade Commission Investigation 337-TA-918. These ITC Orders prohibit the importation of toner cartridges that infringe the Canon patents that Don secured.
