Edward Vassallo is involved in all aspects of patent, trademark and unfair competition litigation, including trials and appeals, in the chemical, mechanical and computer fields, and in oppositions, licensing and opinion work, for clients including S.C. Johnson & Son, Electrolux, Phillips-Van Heusen, Calvin Klein, Inc., Johnson Outdoors, Dreyfus, Revlon, Exxon and IBM. Ed also has had extensive experience in advising clients regarding the intellectual property aspects of mergers, acquisitions and divestitures. He is past President of the New York Intellectual Property Law Association.
Case Highlight
Ed won a complete victory for his client Calvin Klein in a complex trademark dispue with Calvin Clothing Company over the use of the mark “Calvin.” Ed showed that by use of the famous Brooke Shields commericals in the 1980s, where she states that nothing comes between her and her “Calvins”, and by the media’s use of “Calvin” as an abbreviation to refer to “Calvin Klein” apparel, that Calvin Klein had common law rights to “Calvin” that trumped the earlier rights of the defendant in that term. And the court cancelled the defendant’s incontestable registration on “Calvin” for menswear.
