Fitzpatrick Successfully Obtains Grant of Summary Judgment of Invalidity on Behalf of Client IBM

On October 25, 2013, Fitzpatrick successfully obtained a grant of summary judgment of invalidity on behalf of its client IBM. Orenshteyn had accused multiple IBM products of infringing two patents relating to client/server systems and remote computing. Fitzpatrick, on behalf of IBM, argued that the asserted claims were invalid over eight prior art references. Judge Keenan of the Southern District of New York granted IBM’s motion and held all asserted claims invalid.
