Fitzpatrick Obtains Final Written Decisions in Two Inter Partes Reviews Invalidating a U.S. Patent

In decisions issued on April 6, 2016, Fitzpatrick prevailed in two inter partes review (IPR) proceedings, and succeeded in obtaining Final Written Decisions invalidating all claims of U.S. Patent No. 8,297,502 (’502 patent) on behalf of its client Askeladden LLC. The ’502 patent relates to loyalty rewards programs. The PTAB found that Askeladden had shown by a preponderance of the evidence that all of the challenged claims were invalid under obviousness.
 
These Final Written Decisions follow earlier PTAB Final Written Decisions issued in March 2016, in four separate IPR challenges likewise initiated by Fitzpatrick on behalf of Askeladden LLC. The earlier decisions invalidated all claims of U.S. Patent Nos. 8,523,063 and 8,540,152, which are related to the ’502 patent.
