Our client Bausch & Lomb brought suit against a competitor for infringing one of the patents covering the ReNu® family of products. The defendant asserted that Bausch & Lomb’s patent was invalid for indefiniteness because the term “substantially inhibit” as used in the patent was not sufficiently precise to satisfy the patent law. After a trial on this issue, the court rejected the defendant’s indefiniteness argument.
