After discovering knock-off down parkas being sold throughout the New York metropolitan area, Bear U.S.A. turned to Fitzpatrick to help them put a quick stop to the infringement. Fitzpatrick successfully obtained and executed a Temporary Restraining and Seizure Order, confiscating more than eleven tractor-trailer loads of infringing down parkas. Fitzpatrick then went on to obtain a preliminary injunction, a ruling which was affirmed by the Second Circuit Court of Appeals.
