Canon Successfully Challenges IV’s Patent
On September 23, 2015, Fitzpatrick succeeded in obtaining a Final Written Decision of invalidity in an inter partes review of U.S. Patent No. 7,315,406 owned by Intellectual Ventures on behalf of its client Canon Inc. The challenged patent relates to document scanners and had been asserted by Intellectual Ventures against Canon, in a co-pending federal district court litigation, in which Fitzpatrick is also representing Canon. The PTAB found that Canon had shown by a preponderance of the evidence that all of the claims of the ’406 patent are unpatentable under 35 U.S.C. §§ 102(b) and 103(a) for anticipation and obviousness.
