Fitzpatrick Prevails in Arbitration on Behalf of Long-Time Client MasterCraft
On May 29, 2015, the American Arbitration Association denied Correct Craft’s claim that Fitzpatrick client MasterCraft had breached a patent license agreement. Correct Craft brought the arbitration seeking royalty payments allegedly owed by MasterCraft pursuant to the license agreement. Following a claim construction hearing, the Arbitrator construed the key claim term in MasterCraft’s favor, and based upon that construction ruled that MasterCraft’s boats do not infringe and therefore no royalties are owed.
