Fitzpatrick Defeats Motion for Preliminary Injunction for Client IBM.

Fitzpatrick, on behalf of IBM, successfully defeated a motion for a preliminary injunction brought by Fair Isaac in Fair Isaac’s home court of Minnesota. Fair Isaac had asserted several claims, including patent infringement, trade secret misappropriation, breach of contract and copyright infringement in connection with IBM’s launch of its next generation business process management software. At the same time, Fitzpatrick filed a countersuit on behalf of IBM, charging Fair Isaac with infringement of two IBM patents, relating to computerized business process automation and business rule processing. Following the denial of the preliminary injunction, the cases were settled without any admission of liability or wrongdoing by IBM.
