Fitzpatrick attorneys successfully opposed a request for a temporary restraining order in a trademark infringement and unfair competition lawsuit brought by FIFA (Federation International Football Association) against client Nike, Inc. FIFA had objected to Nike’s use of the term USA 03 in connection with Nike’s sponsorship of the USA 2003 Women’s National soccer team, arguing that such use infringed FIFA’s alleged trademark rights in the term USA 2003. The court ruled that FIFA had failed to establish secondary meaning in its descriptive mark, and further found that FIFA was unlikely to prevail on its claims dependent upon a showing of likely consumer confusion.
