Fitzpatrick clients Takeda and Wako, along with their joint venture partner Abbott Labs, sued the generic pharmaceutical company Oakwood and its subsidiary OWL for a declaration that Oakwood’s proposed generic prostate cancer drug would infringe Takeda’s and Wako’s patents. After almost 3 years of pre-trial litigation, including a successful summary judgment of infringement, OWL’s defense of patent invalidity was tried to a jury in Cleveland, Ohio. The jury returned a verdict in favor of our client, upholding the validity of Takeda’s and Wako’s patents.
