In an interference involving surgical navigation technology, Fitzpatrick prevailed on behalf of our client, Medtronic Navigation, Inc. (Junior Party Hunter), against GE Medical Systems Global Technology Co., LLC (Senior Party Ferre). Medtronic established that GE’s claims, which GE copied to provoke the interference, were unpatentable because GE failed to provide a written description of the claimed invention as required by the patent statute. Accordingly, the Board of Patent Appeals and Interferences has entered judgment against GE.
