Fitzpatrick, on behalf of clients Pfizer and Warner-Lambert, won summary judgment of infringement and validity against Teva Pharmaceuticals USA in this Hatch-Waxman Act lawsuit involving a formulation patent covering Pfizer’s Cardiovascular drug Accupril. The court left for resolution at trial the issue of the obviousness of two of the patent claims and Warner-Lambert’s conduct in obtaining the patent.
