Fitzpatrick partner Bruce C. Haas spoke at the 30th Annual Joint Patent Practice Seminar on April 23rd at the New York Marriott Marquis. The topic was “Determination of an Exceptional Case Warranting Attorney’s Fees” in view of the decision in Synthes USA LLC et al. v. Spinal Kinetics Inc. CA 2013-1047, – 1049 (Fed. Cir. October 29, 2013): In this case Attorney’s fees were not granted because the litigation was found not to be brought in subjective bad faith and none of the positions taken in the litigation found to be objectively baseless. co-authored Bruce Haas’s paper for the Joint Patent Practice CLE.
