The Spring 2010 edition of Fitzpatrick’s Trademark Law and Practice Update examines the recent Tiffany v. eBay decision in a slightly different light and reviews other appeals court and district court decisions involving such issues as damages in the context of a trademark infringement and dilution case, and a foreign casino’s unsuccessful bid to enforce its U.S. trademark registration against an alleged infringer. The Update also explores recent Federal Circuit and the Trademark Trial and Appeal Board decisions addressing important prosecution-related points relating to on-line specimens, the likelihood of confusion analysis, and abandonment, as well as changes in Trademark Office Inter Partes practice.
