Landslide : Vol. 3, No. 2
Brian Klock’s article, “The JPML: An Alternative Route to a New Venue” appeared in Volume 3, No. 2 (November/December 2010) of Landslide, the ABA’s intellectual property law publication. Many lawyers may think that multidistrict litigation necessarily involves mass tort or product liability cases having dozens or hundreds of claimants. However, a motion before the Judicial Panel on Multidistrict Litigation may offer litigations an expeditious way of effecting consolidation and venue transfer for pretrial proceedings in patent cases. The author explores the criteria that must be met to have such a motion granted, as well as other factors that may affect a movant’s success.
