e-Bay's Online Sales Do Not Infringe TIFFANY Trademark

This client alert discusses the April 1st 2nd Circuit decision in Tiffany, et al. v. eBay, Inc., which discusses the trademark infringement in the context of the eBay online marketplace. The decision affirms the district court's ruling that eBay is not directly or contributorily liable for trademark infringement merely because some of the TIFFANY-branded items sold on eBay are counterfeits.
