Endo Pharmaceuticals Inc. v. Depomed, Inc.,
Melinda helped obtain a Final Written Decision of invalidity in an inter partes review of U.S. Patent No. 6,723,340 owned by Depomed, Inc. on behalf of clients Endo Pharmaceuticals Inc. and Grünenthal GmbH. Despite previous invalidity challenges to the '340 patent and related patents by others, the Fitzpatrick team was able to show that the asserted claims of the '340 patent are unpatentable for obviousness.
