Fitzpatrick scores victory for client Dentsply Sirona in braces fight
In September 2016, OrthoArm asserted a patent relating to orthodontic braces against our client, Dentsply Sirona, in the Eastern District of New York. Following a Markman hearing, the Court at Dentsply Sirona’s urging found that the patentee disclaimed key subject matter during the prosecution of his application, which finding precluded OrthoArm from maintaining its infringement claims. A voluntary stipulation of dismissal with prejudice quickly followed, and the case was terminated in Dentsply Sirona’s favor.
