Software and Business-Method Patents: A Decade in Review

This article, authored by Michael Sandonato summarizes the developments over the last ten years in the area of software and business methods, and highlights a shift in courts’ focus over the time span from issues concerning whether such inventions constitute patentable subject matter, to issues concerning whether such inventions are novel and non-obvious. Mr. Sandonato gave a talk based upon this article at Fordham Law’s Tenth Annual International Property Law & Policy Conference held in April 2002.
